Since January 2010, all New Jersey attorneys are required to participate in the mandatory continuing legal education program set forth in BCLE Rule 1:42. New Jersey attorneys must complete twenty-four (24) hours of CLE every two (2) years, including at least four (4) hours on topics related to ethics and/or professionalism. The CLE compliance and reporting deadline is December 31. CLE is mandatory for attorneys, judges, in-house corporate counsel and attorneys who work for government entities. Online CLE courses are considered “Internet computer self-study” and fall under alternative verifiable learning formats. BCLE Reg. 201:4 states that alternate verifiable learning format courses are limited to one-half of the total credit requirement in any compliance period. Courses offered under an alternative verifiable learning format must have a reliable method of verifying and recording participation. New Jersey attorneys are generally limited to completing 12 credit hours of online CLE each compliance period. However, some attorneys may be able to complete all 24 required CLE hours through online NJ CLE courses. However, the New Jersey Board on Continuing Legal Education published amendments to the New Jersey CLE Regulations in September 2012. According to Rule 201:8(a), if you reside and work (and are licensed) out-of-state in a jurisdiction that allows alternative verifiable learning formats you are allowed to complete all 24 New Jersey CLE hours through online CLE courses via reciprocity.
